Campaign Finance Board Assesses Penalties, Issues Advisory Opinion

During a regularly scheduled meeting today, the Campaign Finance Board assessed penalties against one campaign. A penalty was assessed against the 2005 City Council campaign of Albert Baldeo. For details, see below:

Other actions taken by the Board:

  • The Board also issued an advisory opinion to address the general requirements of the Campaign Finance Act and the general requirements of the Campaign Finance Program for the April 21 special election for Bronx borough president. Candidates in this special election already had been advised of the requirements set forth in this advisory opinion.
  • The Board determined not to invalidate matching claims reported in disclosure statement #6, which was filed late by 2009 Council candidates Thomas E. Cooke (District 19) and Peter J. Gleason (District 1). Under the law, a campaign’s failure to file a complete and timely disclosure statement may result in the invalidation of all matchable contribution claims reported in that statement. However, based on the factual circumstances, the Board determined not to invalidate the claims contained in the late disclosure statements filed by the Cooke and Gleason campaigns. The campaigns may still be subject to penalties for their late filing of the disclosure statements.
  • The Board dismissed two complaints filed against Albert Baldeo during the 2005 election. One complaint concerned the use of Mr. Baldeo’s law offices. The other involved suspect contributions. The Board’s investigation resolved the issues.
